Hon. Colonial Secretary,
I agree that taking all things into con- -sideration His Excellency's sugestion at (d) is probably the best solution. The Solicitor for such purpose would have to be styled "Assistant to the Crown Solicitor" or some such designa- -tion. It should also be made clear that his services must also be available to instruct the Attorney-General in any proceedings that Lay subsequently go to the Supreme Court
This will of course involve an entire modification of the proposals contained in His Excellency's Confidential Despatch of 9th, August and I would suggest that copies of the Chief Justice's Judgment and his letter to me of 28th. September should be sent to the Secretary of State.
As to C of His Excellency's minute I do not think it would be respectful to the Chief Justice' having regard to the terms of his Judgment, to amend the Ordinance 30 as to establish the locus standi of the Chinese Government in the Courts unless under the directions of the Secretary of State.
